Law (HE): Personal Injury

Personal Injury

Textbooks for Personal Injury
For background on Personal Injury, go to the Tort section at 346.03.  Most textbooks will have a chapter on Personal Injury.

Starting out
Westlaw Insight is the best place to start. Click on the menu for Tort and select Personal Injury to find articles on all aspects of PI including different types of injury and claims, with key cases, legislation and commentary.  You should also refer to the Judicial College (JC) Guidelines for the Assessment of General Damages in Personal Injury Cases which is the essential guide to awards of damages in the UK courts. LexisLibrary provides access to the most recent volume, published in 2017. It is clearly laid out by injury and gives you some useful notes on how the damages are calculated.

Quantum Reports & Cases
Personal Injury Quantum reports are now available on LexisLibrary.  Log in and click on the Practice Areas drop-down list - click on the link to Personal Injury. You will see a link to the Personal Injuries Quantum database in the list on the right, under 'My Bookshelf'. From here you can browse by Type of Injury or Type of Claim (click on the drop down list and select the best match), and also narrow by gender and age.  You can also search by keyword - use this to put any additional relevant details.

You can also search or browse the Personal Injury and Quantum Reports on Westlaw.  This series covers quantum and liability cases, and Westlaw provides links to related cases, legislation and other useful information.   This will be a useful source to find more background on key cases.

Journals and Newspapers
The Journal of Personal Injury Law is available on Westlaw and is quite practitioner focused, offering practical guidance on cases, statutes and regulations relating to personal injury. LexisLibrary provides access to the Medico-Legal Journal.
